Shall refer to any User who has been officially registered with AXNS using the registration form.
Services
Shall refer to any and all services provided by AXNS, that is, Internet connectivity, diskspace, etc, not excluding those in the Services web page.
Description of Services
Atelier-X Net Service provides users with Internet connectivity, software applications and hardware, also known as a "Web Hosting plan". All Services are offered on a pre-paid basis, and AXNS reserves the right to refuse/revoke any application/registration due to unpaid fees incurred by the Customer or as AXNS deems fit.
Acceptance of Terms and Conditions
Your use of the Services implies your agreement for compliance to all terms and conditions as indicated by AXNS.
Privacy Policy
AXNS respects the Customer's privacy and takes sufficient measures to ensure that the Customer's personally identifiable information are not disclosed to third parties, except as specially authorised by the Customer, or in good faith that such action is necessary to comply with the law, the legal process, or to enforce the Terms of Service, or under any other circumstances set in the Terms of Service, as may be amended from time to time.
Usage of Services
The Customer, upon application to AXNS, warrants that he will not use the Services for any purpose that is unlawful or prohibited by the Terms of Service or any official notices by AXNS.
Termination of Services
The Customer agrees that AXNS may, in its sole discretion, terminate the use of the Services, discard any and all data related to the Customer, for any reason whatsoever. The Customer also agrees that AXNS shall not be liable to the Customer or any third party for any termination of Services. AXNS reserves the right to deny any access to any portion of the Site without prior notice. The term of an Agreement shall automatically be terminated unless the Customer provides AXNS with written notice of renewal at least thirty days prior to the renewal date as stated by the Contract Term reflected in the Agreement.
Customer Responsibilities and Liabilities
The Customer shall be held solely responsible for securing their portion of the Services offered by AXNS, without compromise to the overall security of AXNS' Services. The Customer is held liable for any adverse effects caused on the overall performance and availability of AXNS' Services by, not exclusive to, the execution of scripts or any actions made by the Customer. The Customer is liable to all data and content belonging to the Customer and AXNS accepts no responsibility for the data and/or content passing through the Service.
Indemnity
The Customer agrees to indemnity and hold AXNS, and its affiliates, personnel and or partners, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of the Customer's actions, usage of the Service, loss of data, loss of profits, cost of cover, any other special, incidental, consequential, indirect or punitive damages, however caused and regardless of theory of liability, connection to the Service, violation of the Terms of Service, or the violation of any rights of any other entity. This indemnity shall apply even if AXNS has been advised of, or is aware of, the possibility of such damages.
Maintenance
AXNS may conduct routine tests, maintenance, upgrades or repairs on any part of the Service, and prior notice shall be given. The Customer agrees that there may be instances where it is not practicable for AXNS to give advance notice of any disruptions of Service, and AXNS shall be entitled to disrupt the Services to conduct restoration, and or, repairs without prior notice.
Service Disruptions
AXNS shall not be liable for failure or delay in performing its obligations if such failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of any government body, war, insurrection, sabotage, embargo, fire, flood or any acts of God, strike or other labour disturbance, interruption of or delay in transportation, unavailability of or delay in telecommunications or third party services, failure of third party software or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the Services.
